By accessing our website, requesting services, scheduling appointments, or making payments, you agree to these Terms & Conditions.

1. About Our Services

Beyond Comfort Private Care LLC is a Massachusetts-based private home care provider offering compassionate, non-medical support and Certified Nursing Assistant (CNA) services for individuals who require assistance at home.

Service availability may vary depending on staffing, scheduling, location, and client needs.

2. Private Pay Services Only

Beyond Comfort Private Care LLC operates as a private pay provider only. We do not accept health insurance, bill Medicare or Medicaid, process insurance claims, submit insurance paperwork, or guarantee insurance reimbursement. Clients are fully responsible for payment of all services provided.

3. No Medical Emergency Services

Our services are not intended to replace emergency medical care. If a client experiences chest pain, difficulty breathing, severe bleeding, stroke symptoms, loss of consciousness, or any medical emergency, call 911 immediately. Beyond Comfort Private Care LLC is not an emergency response provider.

4. Scheduling Services

Appointments and caregiving schedules are subject to caregiver availability, staffing levels, service area, client assessment, weather conditions, and emergency situations. We reserve the right to modify schedules when necessary while making reasonable efforts to notify clients.

5. Payments

Payment is due according to the agreed service arrangement. Accepted payment methods may include Credit Cards, Debit Cards, Stripe, and other approved electronic payment methods. Failure to make timely payments may result in delayed or suspended services.

6. Third-Party Payment Processing

Payments made online are processed through secure third-party payment providers such as Stripe. Beyond Comfort Private Care LLC does not store complete credit card information, does not control third-party payment systems, and is not responsible for payment processor outages, banking errors, declined cards, or delays caused by third-party financial institutions.

7. Chargebacks & Payment Disputes

Clients agree to contact Beyond Comfort Private Care LLC before initiating a credit card dispute or chargeback. Fraudulent chargebacks for services already provided may be pursued through all lawful collection and legal remedies available.

8. Cancellation Policy

Clients are encouraged to provide as much notice as possible if an appointment must be canceled or rescheduled. Repeated last-minute cancellations may affect future scheduling availability. We reserve the right to cancel or reschedule appointments due to emergencies, caregiver illness, severe weather, or other unforeseen circumstances.

10. Right to Refuse or Discontinue Services

Beyond Comfort Private Care LLC reserves the right to refuse or discontinue services if staff safety is threatened, fraudulent information is provided, illegal activity is present, abusive or discriminatory behavior occurs, payment obligations are repeatedly unmet, or the requested services fall outside our scope of care.

11. No Guarantee of Outcomes

While we strive to provide compassionate, high-quality care, Beyond Comfort Private Care LLC cannot guarantee specific medical, emotional, or personal outcomes. Individual results depend on many factors beyond our control.

12. Website Use

By using our website, you agree not to attempt unauthorized access, upload malicious software, interfere with website operations, submit false appointment requests, impersonate another person, attempt fraudulent transactions, or use the website for unlawful purposes.

13. Intellectual Property

All website content — including logo, branding, graphics, images, text, icons, layout, and design elements — is the property of Beyond Comfort Private Care LLC or is used with appropriate permission. No content may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written permission.

14. Third-Party Links

Our website may contain links to third-party websites for convenience. We do not control, endorse, or assume responsibility for the content, privacy practices, or services offered by third-party websites.

15. Fraud Prevention

Beyond Comfort Private Care LLC maintains a zero-tolerance policy toward fraud. We reserve the right to refuse services involving identity theft, payment fraud, stolen payment methods, false identities, misrepresentation, or unauthorized use of another person's information.

16. Limitation of Liability

To the fullest extent permitted by Massachusetts law, Beyond Comfort Private Care LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from website interruptions, payment processor failures, internet outages, third-party services, delays beyond our reasonable control, or events of force majeure.
